VOLUNTARY 30-DAY NOTICE TO VACATE

Use this form to submit your voluntary 30-Day Notice to Vacate this indicates you and ALL occupants will be vacating the property.

This 30-Day Notice to Vacate must be provided a full 30 days prior to move out. You are responsible for paying the rent through your 30-Day notice period even if you vacate the property early.

Please Note: Per the terms of your RESIDENTIAL LEASE AGREEMENT, it states: “After first initial term, tenancy may continue month to month thereafter, EXCEPT in the months of November, December, and January, during which a three (3) month term shall be agreed on by Tenant. Payment of November’s rent shall be express agreement of the commencement of a three month term beginning November 1st, and expiring on January 31st of each year.”

 

IMPORTANT

You MAY NOT use this Notice to Vacate form if the following applies to you:

  1. You want to vacate/break lease before the end of your lease term
  2. You are a roommate and want to move out

    Pursuant to California Civil Code §1950.5, California law specifically allows the landlord to use a tenant’s security deposit for four purposes: 1. Unpaid rent (which includes late fees and other outstanding charges). 2. For cleaning the rental unit when the tenant moves out, but only to make the unit as clean as it was when the tenant first moved in. 3. For repair of damages, other than normal wear and tear. 4. If the lease or rental agreement allows it, for the cost of restoring or replacing furniture, furnishings, or other items of personal property (including keys), other than due to normal wear and tear.
